ASA refers OneTV to Ofcom

The advertising regulator has referred One TV to Ofcom for repeatedly breaching the broadcast advertising code, which could result in the operator's licence being revoked.

The media regulator has been called in to consider sanctions against One TV by the Advertising Standards Authority after it upheld 65 complaints against the channel last month.

Ofcom has a number of sanctions it can hand out, including fining the company. However, it is understood the regulator is most likely to impose the ultimate penalty, revoking One TV's licence.

Since the publication of the original ruling against One TV on May 10, the ASA has received a further 98 complaints from members of the public.

All of the complaints centre on One TV's failure to provide refunds or deliver orders.

As One TV was continuing to broadcast and take money from customers, the ASA has, "as a matter of urgency", referred the company to Ofcom to consider sanctions. "Having called One TV to a meeting at the ASA earlier this month we have concluded that the channel was not ensuring that it had adequate stock available and was still unable to fulfil orders within 28 days," said the ASA director general, Christopher Graham.

Specifically, One TV has been found in repeated breach of the TV Advertising Standards Code distance selling rules.

ShoppingTelly.com has so far received 523 complaints totalling £39,401 in outstanding orders/refunds.


Looks likethe beginning of the end for OneTV. Ofcom are likely to revoke their transmission licences for continued breaches..

When are Ofcom going to deal with the plethora of quiz channels and their failure to provide intelligence or deliver entertainment ?
