Hi Turok,

You ARE responsible what happens to the item in the postal service. If it arrives D.O.A it is your responsibility.

He should send the item back to you if he wants a refund.

Yes, he can charge back, but he will have to go through the paypal resolution process.

Just tell him that if he wants a refund, he will have to send the item back to you.

Me personally.. I would not ask him for anything back.. Wait until he opens a dispute case against you and then you can post a message in the paypal site there..

Paypal will act as judge and jury and will find the out-come in 3 weeks.. They usually apply the rights to the buyer.. so be prepared for you paypal account to be debited as soon as the resolution process is opened.. if he opens a dispute case..

If he does not open a dispute case against you.. there is not much he can do about it..

Just hope he is a newbie to Ebay.. lol

A decent seller on Ebay would not do that, only the shady characters trying to wriggle out of their resposibilities. Anyone who did that to me and made me wait for the longwinded resolution process would get appropriate feedback left.

Ok, the buyer may be a chancer, but if the item is returned and there's nothing wrong with it, he'll have to pay his own postage and lose out, and you get the item back to resell. If it's faulty on return and there is no evidence of it being done by the buyer, you take the hit and refund.

I've had a similar sort of thing on Ebay. The buyer started by opening a dispute, and I responded by offering a refund when/if the item was returned. Supprise supprie that was the last I heard. Though as the seller it is your responsibility to ensure the item is delivered as described. If you don't want to take the chance of it being damaged in the post insure it.

That said, If I bought something that proved to be faulty, I would be really p***ed if I couldn't get my money back. There is a way to guarantee that you cannot loose out as a buyer, but I won't post it on an open forum as it gives the chancers an extra wepon in ripping people off. If I know you though I'll happily explain by PM.

I've booted up, I've patched in, I'm online, offline, downloaded and extremely cheesed off!

Hello!
thanks,to all in the meantime for there input!
then in uk the law is difrent, when robo, mean, its my responsibility when something happen, here, the say diffrent, the risk of damage is on the post way, parcel was insurance, but seller open it,without make imidatly report of the damage, now he mean the insurance want pay!,because he recogneized it to late!
i think the international shipping rulez a little bit diffrent,on each shipping company!
Gls General Logistic Service, here says, after, the parcel, has opened, and reach the target, the transfer of perils is on the acceptors site, when he not imidatly report it,before open!

i think, the law,in each european country is not the same!
thanks again for your inputs!

this first time happens, that someone try to visa charge back trick

Sorry Robbo..

Disagree totally.. I am a UK power seller and i have a feedback rating of 100%.. and always leave any disputes up to paypal to sort out.. Indecent seller or shady characters have nothing to do with it..

You would not back down if you knew you were right.. So why do it over the internet.. ???

Just be to nice..???.. i dont think so... Its all business.. if you cant handle the heat.. stay away from the fire..

Yes you are right, I would not back down with a seller or buyer if I knew I was right either.

But I don't consider trying to resolve the issue with the other party before using paypal a backdown.

I have had disputes as a buyer and seller. Only once was paypal disputes used, and that is the only time the dispute wasn't resolved. As the seller I had the money and they refused to return the item so I kept the money. A friendly e-mail is a much better start to sorting out a problem, going str8 to paypal just gets peoples backs up IMHO.
