How can it actually be Legal, of itself?

I feel sure one of those clever Barrister chaps will drive a Coach & Horses through it (Within the speed limit, of course).

Edit: Of course, quite a lot of Motoring Defendants have Legal Defence as part of their Insurance, so that'll bump up the cost of Insurance even further.

Oddly, I couldn't find reference to this point in the Linked Article - but I've just had a large plateful of Haggis and Neeps, so am somewhat distracted and might have missed it. Burp.

This sort of backward stance has been adopted by a number of government institutions including the tax man. I currently have an on going battle with the tax man regarding the small amount of redundancy I was paid last December after 13 years continuous employment with a company who had changed their name. When applying for a tax rebate I was slammed with a tax bill for 20% of the value of the redundancy money and told to prove it was a genuine redundancy payment.

Typical, so it means that for the average man in the street, unless it is a licence losing conviction, it won't be worth fighting it, yet for the wealthy, nothing will change, as they can easily afford legal representation.

If they're losing cases and having costs awarded against them then they should make sure that have better advice on what cases to prosecute!

Perhaps if a case falls then costs should be awarded against the faceless bureaucrats who made the decision to go ahead?

Out here in Lanzarote a friend got a fine through the post for 90 Euro for not wearing a seatbelt. He asked about it and was given a date of the offence. Asking for further proof he was told a police officer saw him without a seatbelt and thats that no further proof needed. He was not stopped at all they just saw him!!!

Not a lot of point arguing with the idiots here as they will give you more grief, so he had to pay it.
