NEW DELHI: DTH players such as TataSky and Dish TV will soon be stopped from broadcasting live international cricket action starring India, unless they have a direct agreement with the sports broadcaster holding the telecast rights.

A top source in the Board of Control for Cricket in India (BCCI) told ET that the information and broadcasting ministry has assured the cricket board the government would soon issue guidelines to stop DTH players from relaying cricket feed provided free to Doordarshan (DD).

The technical sub-group (under the guidance of state-owned Broadcast Engineering Consultants India Ltd) set up by the Union Cabinet to look into the issue of sharing live feed with DD is of the view that DTH must be considered as a separate platform and must not be allowed to ride on free telecast offered by DD, a source in the I&B ministry said.

At present, all broadcasters are mandated to share clean feed of all international matches that India plays (both within the country and abroad) with DD. Since DTH operators are mandated to offer Prasar Bharati channels as per their licensing conditions, they get to carry the cricket telecast without an agreement or paying any fee to the sports broadcaster.

The move will benefit broadcasters such as Nimbus, who maintain that DTH players are using the loophole to air international cricket featuring India for free. Earlier, Nimbus had dragged Tata Sky to the Delhi High Court alleging that the DTH player was infringing upon the copyright of Neo Sports by showing the matches on its platform.

The Delhi HC however refused to grant a stay as TataSky argued that it only following the license conditions which mandates that it shows Prasar Bharati’s Doordarshan, including the channels (DD National & DD sports) which telecasts the feed provided by Nimbus-owned Neo.

Private broadcasters such as Nimbus, ESPN-Star and Zee (which on Wednesday pulled out of the $219 million deal with BCCI) had alleged broadcasters would incur losses to the tune of Rs 1000 crore over the next 18 months on account of non-encryption of the shared feed by Doordarshan (which results in operators in other Asian countries pirating the same) and DTH operators using the DD signals for free. In fact, while Nimbus is renegotiating its $612-million contract with BCCI, Zee cited this as the reason for pulling out of its contract with the cricket board.
