6. So instead, the prosecutors pursue the criminal route with the hope of intimidating publicans with the fear of potential loss of livelihood if convicted.

Speaking after the case, Mrs Dixon, who is now unemployed and lives in Birches Head, said: "So many other publicans will be glad to see we're not guilty because these cases are being brought all over the place.

Any idea as to why Mrs Dixon is (currently) unemployed ?

And additionally, is Mr.Dixon also unemployed? I'm guessing they were managers of the pub, not the licencees and by being charged and appearing in court they possibly breached the terms of their contract. The company (licencees) may want to distance themselves from whats gone on as it could have reflected negatively on any licence renewal........I guess the company turned a blind eye to any increase in turnover showing 3pm's would have brought.

Indeed the report in the opening post says that the Dixons were managers, so sonnetpete is probably correct. Personally, I don't know more about this particular case than what I've read in the opening post.

The first thing that came to mind was "up Birchees 'ead, duck." :D

Just noticed today actually that our nearest pub has had a fairly large dish put up, looks as if it's pointing at 5°E for Viasat.

The result of this case is definitely good news, for now anyway.

Orbit Showtime programmes which are available in North Africa and the Middle East at a cost of £3,120-a-year.
Was it really that expensive ?
£3,120 per annum seems outrageous for a middle east providor,500-1000 euro is the going rate for a Showtime card and receiver nowadays .
Longton-based Platinum Satellite had a nice cut .:eek:

Not really for a beer glass license, it is half what sky ask for, I suspect what you are quoting is for a single home viewer card

Yes, but that's what they're selling Topper, none of these companies are selling commercial subscriptions, as that would involve letting the provider know where the card is going to and it would be switched off.

The fox and duck is one of my local boozers, and virtually every pub i see on my travels across stoke and newcastle under lyme has got the viasat package running....some installer is making a lot of cash.

Just a comment on ECJ and the opinion of the AG - The ECJ is not going to ignore the opinion of the AG for two reasons;

(i) This is a fairly fundamental point of EU law - that of exclusivity within the Union, there is no way the chamber can form any other conclusion.

(ii) These types of courts, namely the ECJ, and the ECHR here in Strasbourg, do not function in the way you imagine a court functions in the UK, they are different. Cases are processed by the registry (lawyers who work for the court) and a conclusion is reached long before the case is ever seen by a judge. At the ECJ the AG's head up the different sections of the registry.

In fact most of the judges are not actually judges, some are law professors etc and the system of appointment is somewhat 'dodgy' especially at the ECHR, at the ECJ 5 of the 8 AG's are appointed by the 5 largest members of the Union so some influence over the judges is maintained.

Just thought I'd clarify this:)
