I feel like I am being scammed by customer and Paypal

I run a small business. Usually things run smoothly but sometimes we get some richard heads who basically like to mess us about.

To cut a long story short, a customer paid for a custom made unit from us. We used the money he paid us, to pay the factory. Delivery date, mid May 2016. The customer knew this. And yet just a week short of the expected delivery date, what does he do but put in a chargeback claim on all the money he paid us, which means we have lost hundreds of pounds we paid the factory for his unit. In other words, his credit card company stole our/my money. HIS money is at the factory, making the item he wanted.

So I was told to go to Paypal to sort this out. It seemed fairly straight forward. Send all the evidence in our favour to the Paypal Resolution Centre. All except the email they gave me bounced 10 times. Paypal say 'try again'. I also tried to put some jpgs and notes on the Resolution page and all those came backs as errors. 'Upload failure'.

So I rang Paypal 23 times. One woman who seemed nice said she would ring me back in ten minutes. No prizes for guessing she did not.

I have 5 days left to put forward my case but I can't even do that. If I don't, I lose all my money and will be fined by Paypal too for 'ripping off a customer' yet we/I are the one being ripped off.

Has anyone else experience of this Chargeback scam??? Thanks. :)
 
If all else fails, small claims court followed by bailiffs against the thief, maybe even police action as it is an act of fraud against not only yourself but at least three financial institutions (your bank, PayPal and their CC company)...

My bank has nothing to do with it. It's his bank or credit card company that has taken my money out of my Paypal account because 'inferior goods' were sent. In fact they weren't even sent as I said, so he's lying. The goods are still at the factory. He is based in the America, so I assume it's an American bank. Maybe different rules, but my money is missing. I just can't seem to be able to get my case across

Can you give us an idea of the amount involved?
 
It may be a different web address for your location but did you try the web forum? Posting in that section may get you some help a bit faster.

Your biggest problem is left over right, if you went " right over left " 90% of judges in the US would back you. But , there is the odd 10%

Even better, hire yourself a lawyer from over there, you'll get everything the guy owns then... :D
 
Yes the chargeback scam is well known and simple to implement, although I have to confess I did not know about it until last week myself when I sold a new but surplus to us integrated dishwasher. I am assuming this was done via Ebay, but you do not mention it at all apart from mentioning the resolution centre. All these transactions are weighted in favour of the buyer not the seller and I personally would never dream of using Paypal for large business amounts for that very reason that the seller has almost zero protection from chargebacks.

You need to speak to them again and also find out why the resolution centre does no do what it says on the tin.

In fairness though, chargebacks can take place against credit or debit card transactions in any bank but they rely on a person's integrity and these days especially in business, nobody has any. I sympathise but can offer no sound advice

Thanks for the replies. The amount we're talking about is over £300. Not a lot to someone like Simon Cowell, but I could pay two bills with that. And it is my money after all. Money I have earned. A hard grafted week's wages to some folk.

I have contacted the financial-ombudsman this morning and they said they would take up my case. But I don't hold out much hope.

If he has done that then they are probably fake, as if he was going to scam you he would not send you a photo that would enable you to tip off the US authorities

How far off the floor were the images he sent you ?
