"Kokott will not deliver her opinion now until February 3. The opinion will be handed down in the Grand Chamber of the European Court of Justice, in Luxembourg.

It is unclear why the advocate general’s opinion has been put back.

Once the advocate general has given her opinion, judges at the ECJ are expected to give their verdict within three months.

But this will not be the end of the case, as their judgement will be sent to the UK’s High Court, which will sit again for the case."

Yes, heard it on the news ................ but the consequences may not be beneficial for all. Personally I'm all for choice and competition, but competition doesn't always lead to reduced subscriber costs. The cost of Rights could well rise dramatically to cater for the wider legitimate audience and those costs will surely be passed on to the punters.

Still very much a "wait and see" issue, I'm afraid.

On the plus side, the legitimisation should bring greater reliability and predictability (qv Tring etc. this season!) and perhaps reduce the take of the middle-men.

Nothing to wait for, if an FAPL guy turns up and enquires as to the Sky Italia Logo, or the Sky Germany Logo, or Tring, or Viasat, does he have any right to see your Credit Card details for that transaction, do they police those Subscriptions ?

The FAPL have just had their teeth pulled, and yes in the future things may turn for the worse, or better, but today its Dodge City, just go for it.

I cant contain misen :p

Yeah but it's a non binding opinion from the advocate, which the premier league could still challenge ?

I'm all for choice in pay tv operators but I just can't see the tv operators paying for pan european rights without a quarantee that the extra subs across Europe will make them a return on the money spent.

Also what happens to the 3pm blackout of games in the uk ?

Hopefully this might mean I can finally get a legit sub to nova, maybe but doubt it.

Its an outdated restrictive pratice designed to protect the FAPL and SKYs profits, exhorbitantly high profits, and is part of a system which is against European Law, the Top Legal bod says so.

I would imagine the "FAPL Enforcers" are picking up their P45s at the end of today.

Who knows how it will all shake out, but short term, its good

If rights are to be sold across whole of Europe, I can see only a hand full of tv providers that will be able to do it.

Correct me if I'm wrong but wasn't the case of using foreign systems not for the freedom of choice in the eu but down to the price sky was charging for commercial premises due to there monopoly and was out of order resulting in the rise of these systems coming in to the country ?

The truth is Europe is not a single market at all. In countries where they earn half the amount (compared to the UK) charging the same for a subscription could only have a negative impact on viewer numbers.

It doesn't have to be a monopoly though where the big guy wins, it could be charged by number of viewers... Or stipulated the audio is for only one market.

Yes, the hyperinflation has been spiralling out of control. $ly is demanding way too much from their subscribers, so they only have themselves to blame.

The principle in European law and directives is simple, free movement of goods and services within the EU borders (and as free as possible in the EFTA area). That is the point of the EU!

I wouldn't be surprised if $ly end up being fined for being in breach of such laws. O-Ha


Everyone should exercise their rights to free trade. I certainly do. :cool:

Except that prices across the board may well rise to the extent that only the dedicated, the rich and the foolish will buy - and the boom of which you talk may well become a bust, with the result being fewer, more powerful, providers. And Sky are too clever for one of them not to be them. Square one.

All that has happened right now is your FAPL guy is on "other duties". There is a long, long way to go before the market starts to contend with the opportunities - and the problems.
