Ahh - so no chance of changes happening on October 4th as whatever happens there will be appeals.

In a judgment by the Regional Court in Bonn on August 30, requested by Media Broadcast, Eutelsat was ruled to be prohibited to use the frequencies beyond October 4, 2013.

Eutelsat says it will now appeal against the decision, underlining that it does not intend to create any harmful interference.

The Tribunal now moves into a second phase, among them whether SES was entitled to sign an agreement in 2005 with Media Broadcast without breaching its obligations under the ICA. SES disputes those claims.

So do SES take over after October 4th? Or wait until the second phase of the tribunal outcome is known?

Could they switch to Astra and then back in the unlikely event that the appeal goes to Eutelsat's favour?

Luxembourg, 16 September 2013 – SES has been granted rights to use German Ku-band orbital frequencies at the 28.5 degrees East orbital position effective from October 4, 2013 onwards pursuant to a 2005 agreement with German media service provider, Media Broadcast (“MB”) (as successor to T-Systems Business Services).

The agreement will give SES the right to use, on its fleet, 500 MHz of bandwidth at this orbital position adjacent to SES’s 28.2 degrees East in the frequency bands 11.45 – 11.70 GHz and 12.50 – 12.75 GHz in downlink and 14.00-14.50 GHz in uplink. SES has procured and will launch and operate new satellites (ASTRA 2E and ASTRA 2G, where launch is currently scheduled for this and next year, respectively) at the 28.2/28.5 degrees East orbital arc, along with the ASTRA 2F satellite which was launched last year, to replace SES’s existing fleet at 28.2 degrees East and to provide new capacity. The new satellites in this neighbourhood will use the additional frequency spectrum as of October 2013 for DTH satellite television services in the U.K. and Ireland and for other services inside and outside of Europe.

Satellite operator SES (Astra) won the first stage of arbitration and satellite operator Eutelsat right to frequencies from position 28.2 ° E / 28.5 ° E . SES can now run October 4, 2013 broadcast in 500 MHz band, which currently uses Eutelsat 28A .
This is a frequency band from 11.45 to 11.70 and 12.5 to 12.75 GHz. The rights they acquired SES (Astra) based on agreement of 2005 with the German media service provider, Broadcast Media companies, as successor to T-Systems Business Services. Media Broadcast is licensed on these frequencies issued by the Bundesnetzagentur, the German regulator.
However, the controversy is far from over. While SES may begin early next month migration frequency and contracts with companies such as Arqiva, Globecast and other broadcasters, Eutelsat will continue in the second phase of the arbitration.
Eutelsat for example, says that it can demonstrate that it has the regulatory authority to operate the controversial frequencies and wants to appeal.
Disputes about the frequency bands undoubtedly influence both satellite operators. Eutelsat loss of income and profits from leased transponders and SES will have a corresponding gain in revenue

we need to wait and see what ses will be take freuqncy from eurobird to astra 2f
it not clear yet
11450-11700 it can or pan Europe beam or uk beam
also 12500-17500 or uk band or pan Europe beam
the people east Europe will be problem signal even large dish

I'm surprised this hasn't caused more debate or interest on satellite forums. There could potentially be over 250 services on Sky and Freeset needing to switch frequencies and reshuffle uplinks next month. This includes various big Sky SD channels too.

Yes, I can't see how there won't be some downtime if the switch over goes ahead. At least this keeps some of the bigger channels safe. Comedy Central and BT Sport still have a number of channels on Eutelsat that might want to move too, at least for now. There are still a few empty Astra transponders transmitting blank carriers at the moment that I guess could be used. I suppose some of the smaller channels will just have to live with some disruption unless SES fire up some more of the transponders between 10.979-11.200GHz for more channels to move over.

Well at least we know why 2F was under utilized now. How many transponders does it have? 10950 to 11450 is 32 transponders. It's already got Africa beam between 12500 and 12750 and if that section is also covered into the UK that would be another 32 transponders (more or less, depending on bandwidth).

It's 27500 for sure but I assumed it's the usual 2/3 but my TM6900 doesn't show the FEC. Working fine here in South Bucks.

Its FEC 3/4 according to my 7020! Thats odd for 28E!
